Homelab Terms and Conditions

    These Terms and Conditions ("Terms") govern your use of the Homelab platform ("the Platform"), operated by RE:PLACE CITY LIMITED, a company registered in England and Wales with company number 15725892. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Platform.

    Homelab is not an estate agent, letting agent, or legal intermediary. It does not participate in or facilitate negotiations, viewings, offers, payments, or legal transactions between users. Homelab is not a party to any transaction arising from its advertisements.

    Users must conduct their own due diligence and seek professional legal advice (e.g., from a solicitor) before entering into any contractual agreements.

    3. Use of the Platform

    By using the Platform, you agree that:

    1. All information provided by you is accurate and not misleading.
    2. You will not use the Platform to distribute illegal, harmful, or obscene content.
    3. You will not interfere with other users' access or operation of the Platform.
    4. You will not impersonate any person or create false listings.
    5. You will not harvest data or send unsolicited information (spam).
    6. You will not copy or reproduce any content without permission.
    7. You will keep your login credentials secure.

    4. Obligations of Advertisers

    Advertisers (sellers and landlords) confirm that:

    1. They have legal authority to advertise the property.
    2. The listing does not breach any law or contract (e.g., mortgage, insurance).
    3. All necessary permissions (e.g., from freeholders or mortgage providers) have been obtained.
    4. The property complies with applicable regulations, including:
      • Energy Performance Certificates (EPCs)
      • Gas Safety Certificates
      • Electrical Safety Standards
      • Smoke and Carbon Monoxide Alarm Regulations
      • Licensing for Houses in Multiple Occupation (HMO), if applicable
    5. All contents provided (text, photos, videos) are accurate and lawful.
    6. Advertisers indemnify Homelab for any legal claims or losses resulting from their listings.

    5. Obligations of Property Seekers

    Buyers and renters agree:

    1. To conduct their own due diligence.
    2. To verify the legal status and ownership of any property.
    3. To engage qualified legal professionals before proceeding with a purchase or rental.
    4. That Homelab bears no responsibility for the accuracy or legality of listings.

    6. Content and Intellectual Property

    1. Users retain ownership of submitted content but grant Homelab a royalty-free, perpetual license to use, modify, and distribute it.
    2. Homelab may edit or remove content that violates these Terms or applicable laws.
    3. Users confirm they have all rights and permissions to share any uploaded content.

    7. Third-Party Services

    1. Homelab may offer third-party services (e.g., EPC certificates, inventories) for which it receives commission. These services are optional.
    2. Homelab is not responsible for delays, quality, or outcomes of services provided by third parties.

    8. Fees and Refunds

    1. Prices for advertising are per listing and apply until the listing is removed.
    2. Services are digital and begin upon purchase; therefore, refunds are not available after service commencement unless at Homelab's discretion.
    3. Advertisers may remove listings at any time.

    9. Fair Use Policy

    1. Homelab may remove or restrict listings that generate excessive activity or appear inaccurate.
    2. Listings older than four months may be suspended.
    3. Homelab may request proof of ownership or compliance documents.
    4. Accounts misusing the platform may be limited or suspended.

    10. Customer Support and Complaints

    1. Support queries will typically be answered within one working day.
    2. Complaints must be submitted in writing to info@homelab.uk.
    3. Complaints will be acknowledged within three working days and resolved within 15 working days.
    4. If unresolved, users may escalate to The Property Ombudsman, subject to eligibility.

    11. Personal Data

    1. Homelab is the data controller of user data.
    2. When user data is transferred to advertisers, the advertiser becomes a controller and must comply with data protection laws.
    3. Details are outlined in the Privacy Policy.

    12. Legal Jurisdiction

    These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts.

    13. Limitation of Liability

    1. Homelab is not liable for any direct, indirect, or consequential losses related to the use of the Platform.
    2. Homelab does not guarantee the accuracy, reliability, or legality of any content or listings.
    3. Users are solely responsible for all actions taken as a result of engaging with other users or listings.
    4. Nothing in these Terms excludes liability for death or personal injury caused by Homelab's negligence or any liability that cannot be limited under UK law.

    14. Amendments

    Homelab reserves the right to amend these Terms at any time. Continued use of the Platform constitutes acceptance of any changes.
